These Terms of Service (“Terms”) govern your use of the Crafty Tomato website, physical studio, reservations, classes, events, and all related services and purchases (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use our Services.

Crafty Tomato (“we,” “us,” or “our”) operates this website and physical studio. These Terms apply to all users of the site, including browsers, customers, and contributors of content. We reserve the right to update, change, or replace any part of these Terms at any time by posting updates to our website. Continued use of the Services following any changes constitutes acceptance of those changes.

By using our Services, you represent that you are at least the age of majority in your state or province of residence, or that you have obtained consent for any minor dependents to use the Services under your supervision and responsibility.

All reservations, class tickets, workshop bookings, and event registrations are non-refundable, as outlined in our Refund & Return Policy. By booking a reservation or class, you acknowledge that your purchase reserves limited seating, staff time, and materials, and therefore no refunds will be issued for cancellations, no-shows, or changes of plans. Rescheduling may be offered at our discretion and is subject to availability. Crafty Tomato reserves the right to modify class schedules, instructors, projects, materials, or cancel events when necessary.

Participation in in-store craft activities involves the use of art materials, tools, and equipment. By participating, you acknowledge and voluntarily assume all risks associated with these activities. Crafty Tomato is not responsible for injuries, allergic reactions, damage to clothing or personal belongings, or any other loss resulting from participation. You are solely responsible for supervising any minors in your care while in the studio, and participation in all activities is at your own risk.

All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to refuse or cancel any order, limit quantities per person or order, and correct pricing or description errors at any time. Payment information is processed securely through third-party payment providers, and we do not store or have access to full payment details.

Returns, exchanges, and refunds are governed exclusively by our Refund & Return Policy, which is incorporated into these Terms by reference.

By providing your phone number or email address, you consent to receive transactional communications related to your reservations, orders, or account activity, including confirmations, reminders, and important updates. Marketing messages are sent only if you have opted in. Opting out of marketing messages does not prevent us from sending essential transactional communications necessary to fulfill your reservation or purchase.

All content on this website and within our studio, including logos, branding, artwork, text, images, and product designs, is the property of Crafty Tomato and may not be copied, reproduced, distributed, or used without prior written permission. Customer-created artwork remains the property of the customer; however, Crafty Tomato may photograph or display completed projects for promotional purposes unless otherwise requested in writing.

You agree not to use the Services for unlawful purposes, interfere with the operation or security of the site, harass or disrupt staff or other customers, or attempt to gain unauthorized access to systems or data. We reserve the right to refuse service or remove individuals from the premises at our discretion.

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service, nor do we guarantee that the results of any craft activity will meet personal expectations.

To the fullest extent permitted by law, Crafty Tomato shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount paid for the applicable service or product.

You agree to indemnify and hold harmless Crafty Tomato, its owners, employees, and affiliates from any claims arising out of your breach of these Terms, participation in in-store activities, or violation of any law or third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Arizona.

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and Refund & Return Policy, constitute the entire agreement between you and Crafty Tomato.
